Questions to ask when forming a DUI defense

A DUI charge may be more serious than you realized in Maryland. Did you know that you could get both fines and jail time, and that the penalties go up the more DUI convictions you have on your record? Did you know that your license could also be taken away from you?

As you can see, setting up a proper DUI defense is quite important. Make sure that you ask yourself the following questions, and then you and your legal team can address each point in turn.

-- Why were you originally pulled over by the police?-- Can you explain your erratic driving -- if that led to the incident -- with something other than alcohol?-- Did the officer follow all of the proper procedures when pulling you over, talking to you and investigating the situation?-- What type of equipment did the police use, if any, to decide that you were under the influence of alcohol?-- What was the condition of that equipment?-- Do you think it was accurate or inaccurate?-- Were there any outside factors that could have led to your failing basic field sobriety tests?-- Were mistakes made when it comes to the steps that the police followed or the records that they created during the arrest?-- If needed, were you read your rights?
